The Tallinn Circuit Court did not change the decision of the Pärnu County Court. The county court acquitted OÜ Tervise Paradiis and its senior instructor.
On March 11, 2023, a visitor drowned in the pool of Tervise Paradiis water center. He died. According to the charges, he did not receive timely assistance that could have saved him.
The senior instructor was accused of assigning a substitute for the lifeguard position to a person who worked as an administrator. This person had not received the necessary training.
The Pärnu County Court acquitted the senior instructor and OÜ Tervise Paradiis. The prosecutor's office and the representative of the victim filed an appeal.
The Tallinn Circuit Court found that the senior instructor did not violate the duty of care. It was not required that the lifeguard had undergone special training.
Since the charges against the senior instructor were not proven, the acquittal of OÜ Tervise Paradiis also remained unchanged.
The Circuit Court only changed the decision regarding legal costs. The court decision has not yet entered into force. A cassation appeal can be filed with the Supreme Court within 30 days.
