The Court Denied Duo Media's Complaint
Tallinna halduskohus ei rahuldanud Duo Media kaebust raadiolubade konkurentsi kohta.
The Tallinn Administrative Court did not satisfy Duo Media's complaint regarding the radio license competition.
Duo Media Networks OÜ filed a complaint against the decision of the Consumer Protection and Technical Regulatory Authority (TTJA). The case concerned the competition for radio licenses. TTJA regularly allocates radio frequencies. Duo Media Networks OÜ previously operated under the name Narodnoe Radio. Now they challenged TTJA's decision to grant a new radio license to Baltic Media Network OÜ. Their radio station is called RADIO MAXIMUM.
Duo Media said that TTJA made mistakes. These mistakes helped RADIO MAXIMUM to win. The court found that TTJA did not make mistakes. The court stated that RADIO MAXIMUM's program is more suitable for the target audience. It is also a new player in the market.
Jüri Pihel, Chairman of the Board of Duo Media, said that they plan to defend their rights. He said: "Duo Media will use all legal means. We believe that we will achieve a successful result."
Pihel said that the reasons for not granting Narodnoe Radio's license were strange. He said that the new radio station's license was based on rock music and pop-rock music. Narodnoe Radio, however, played regular music. Pihel did not understand why state officials should prescribe which music is good and which is not. He found it difficult to find a similar case in the last 30 years.
