Varro Vooglaid is a member of the Riigikogu Legal Affairs Committee and a lawyer. He said that the law does not prevent Chancellor of Justice Ülle Madis, who is currently in office, from running for president.
Vooglaid wrote on social media that some opinions are misinformed. They say that the law does not allow the Chancellor of Justice to hold another public office. The law also does not provide that being elected president would terminate the Chancellor of Justice's mandate. However, Vooglaid stressed that these opinions do not comply with the law.
He explained that according to the Constitution, all other offices of the president terminate when they assume the presidency. This means that if Madis is elected president, her term as Chancellor of Justice will end.
Vooglaid added that the office of Chancellor of Justice is an appointed position. The Riigikogu appoints the Chancellor of Justice on the proposal of the president. The Constitution is superior to the Chancellor of Justice Act. Therefore, what the Chancellor of Justice Act says is not important.
He said that if Madis is elected president, her term as Chancellor of Justice will end immediately. No law prevents this. Vooglaid emphasized that this is valid legal regulation.
EKRE chairman Martin Helme said that Madis has a conflict of interest as Chancellor of Justice. This could lead to the election results being challenged in court.
