The Prosecutor's Office has begun analyzing whether there are grounds to initiate criminal proceedings against Pihlakodu. This concerns the rape cases at Tabasalu Pihlakodu. State Prosecutor General Astrid Asi said that previously there was not enough evidence that the rape caused health damage to the wards.
Asi said that the Prosecutor's Office is currently investigating whether there are grounds to initiate criminal proceedings. Additional information has been requested in the last week. Responses are awaited to make a final decision. Asi did not specify exactly from whom the information is being requested.
Eesti Ekspress wrote that although the criminal investigation found multiple victims, the Prosecutor's Office does not see Pihlakodu itself as guilty. According to 'Pealtnägija', there were eight victims. In court, only the crime is discussed, as the Prosecutor's Office believes there is no evidence that the sexual crime caused health damage to the demented wards.
Prosecutor Arika Lepp said that not every non-consensual sexual act necessarily causes mental and physical health damage. The Prosecutor's Office's stance has caused public discontent. It has been criticized by both ordinary people and legal scholars and lawyers.
