The water damage occurred in the apartment below. Krista's apartment was above it. The building had previous problems with the roof. The roof was leaking and caused moisture.
The insurance company stated that Krista's apartment was the cause of the damage. Krista disagreed. She asked why the claim was only made now, when the apartment had already been sold.
Swedbank responded that they have the right to claim money within three years. They did not see any fault in their delay.
Krista's apartment was insured with Ergo. The insurance ended in September 2023. Swedbank filed the claim almost two years later.
Krista believes the water may have come from the roof. However, this can no longer be proven, as the apartment has been renovated.
Ergo stated that claims can be filed for up to three years. If notified later, it is difficult to gather evidence.
Consumer protection cannot assist in such cases. The burden of proof lies with the party claiming the money.
