Chancellor of Justice Ülle Madise asked the Supreme Court to recognize part of the Traffic Act as unconstitutional. She says that the Traffic Act does not allow for refunds if a car is stolen, destroyed, or no longer used for other reasons.
Madise says that the Traffic Act is partially in conflict with the constitution. She states that the law lacks clear rules for refunds. Madise already made a proposal to the Riigikogu last year to amend the laws.
The Riigikogu supported Madise's proposal and amended the Motor Vehicle Tax Act. The new rules allow for a reduction or refund of the tax if the car is stolen or destroyed. However, the Riigikogu did not change the Traffic Act. This means that the registration fee is not refunded.
Madise says that the Riigikogu fulfilled her proposal only partially. She states that changes are also needed in the Traffic Act. Madise wrote that amending the tax law may take more time, as new tax benefits for families with children were being developed simultaneously.
