Harju County Court annulled the decision of the Data Protection Inspectorate to fine Pere Sihtkapital €30,000. The court found that the foundation had fulfilled the data protection requirements.
On Tuesday, Harju County Court annulled the decision of the Data Protection Inspectorate (AKI). In June 2024, AKI had imposed a €30,000 fine on Pere Sihtkapital. AKI believed that the foundation had not sufficiently complied with the requirements for processing personal data during the study on childless families.
Katrin Kiisk, the chairwoman of the board of Pere Sihtkapital, was satisfied with the court's decision. She said that the evidence presented to the court showed that data protection was in order. The Ministry of the Interior had entrusted the data to the foundation after previously verifying the data protection requirements. The foundation stored the data in encrypted and anonymized form. The study organizer consulted with AKI, the Ministry of the Interior, and the ethics committee.
Kiisk regretted that the study data had been lost. When suspicions arose in the media, the foundation halted the study and deleted the data. Kiisk said that it took almost two years to reach a court decision, which is why it was the right decision. The foundation is considering filing a claim against the state, as the discontinuation of the study caused damage.
Kiisk said that the foundation plans to continue the studies. The birth rate has been at a record low for the third year in a row, making research on childlessness and fertility very important. The foundation will review the matter in light of the court decision and make a further plan.
In June 2024, AKI decided to fine Pere Sihtkapital €30,000. AKI believed that the requirements for processing personal data had not been sufficiently met. Although the Ministry of the Interior had agreed to the processing of the data, AKI decided to impose a fine. Pere Sihtkapital did not agree with the decision and went to court.
