The Ministry of Social Affairs decided to analyze the pension rules for rescuers. This happened after the court overturned the decision of the Social Insurance Board. The Social Insurance Board did not include the training of rescuers in their length of service. The Rescue Board said that training is part of the job, but the Social Insurance Board did not agree with this.
In April, the Tartu Administrative Court ruled in favor of a rescuer whose length of service had been miscalculated by the Social Insurance Board. This is not the first time rescuers have had to defend their rights through the courts. In 2023, there was a rescuer whose parental leave was not included in the length of service. His complaint was also accepted by the court.
The Social Insurance Board changed its rules after the court decision. Now parental leave is also included in the length of service. The Social Insurance Board said that they reviewed their pension decisions in the fall of 2024. Now they also take into account parental leave.
Currently, there are three more disputes between rescuers and the Social Insurance Board in the Tartu Administrative Court. The Social Insurance Board is analyzing how to change its rules based on the new court decision.
ERR asked the Ministry of Social Affairs whether the current rules are correct. The Ministry's advisor said that they are now reviewing the rules. They are conducting an analysis and will decide whether the rules need to be changed.
Police officers, rescuers, and prison officers are entitled to a special pension if they have worked for at least 25 years. The Rescue Board said that training is part of the length of service because rescuers receive a salary and leave during the training period.
