The Supreme Court decided on Monday not to accept the appeal from Kuusemaa's defense. The circuit court's decision became final. The court sentenced Kuusemaa to three years and nine months in prison.
The circuit court found in May that Kuusemaa had known about her pregnancy since at least December 2023. The court examined her internet searches. The birth was not unexpected for Kuusemaa.
The court found that Kuusemaa cut the umbilical cord of the newborn. However, the killing cannot be attributed to blood loss caused by tearing the umbilical cord. The court noted that Kuusemaa suffocated the newborn, causing respiratory failure.
In Läänemaa, Suure-Lähtru, a family dog brought the body of the newborn to the farmyard on February 5, 2024. The police launched an extensive search to find the baby's mother.
After identifying the mother, it was revealed that the woman had traveled to Morocco. The Moroccan police arrested her in early March. In July, Kuusemaa was brought to Estonia and has been in custody ever since.
