Harju County Court decided on Friday that Pakrineeme Sadama will not receive money from Elering. Pakrineeme wanted 2.77 million euros from Elering plus late fees. The court also did not award the 100 million euro compensation.
The court found that Pakrineeme and Elering did not make a lease agreement in 2022. They discussed several options but did not reach an agreement. The court said Elering had no obligation to lease the pier or obtain a usage permit.
The court also said that governments decided in October 2022 to deploy FSRU to Finland. Pakrineeme and Elering had no contract that would justify the 100 million euro claim. The court found that Elering did not illegally use the pier.
The court stated that the pier located in public waters belongs to the state. The issue of technical facilities fee was not important because there was no enforcement.
After Russia's attack on Ukraine, Pakrineeme and Elering worked together to create LNG capabilities. Pakrineeme built a pier in Paldiski, Elering built gas infrastructure. In March 2023, Pakrineeme sold the property and infrastructure to EVK. The loading facility was installed in early 2024.
The court decision is not yet final. An appeal can be filed within 30 days.
Pakrineeme Sadama belongs to Alexela and Nordic Stream Group. According to the business register, the actual beneficiaries are Enn Pant and Heiti Hääl.
