Chancellor of Justice Ülle Madise has submitted a request to the Supreme Court. She wants the Supreme Court to declare the fee laws of three municipalities invalid. These municipalities are Loksa city, Jõelähtme parish, and Viimsi parish. She previously did the same for Keila city.
Madise wrote that the law of Jõelähtme parish is against the law. This law imposes greater obligations on developers than other laws allow. The parish law requires developers to pay 6500 euros for each dwelling. In Madise's opinion, this law is wrong because it violates rights and freedoms.
Madise said she requested Jõelähtme parish to change the law in April. The parish has not done so. The parish said their law is correct. They believe they have the right to request this fee.
Loksa city has a similar problem. There is also a fee of 6500 euros. Madise said that if the developer does not pay this fee, the city may cancel the planning. This is wrong because the law does not allow such penalties.
In Viimsi parish, the fees are different. For the general plan, the fee is 5000 euros; for modifications, it is 10,000 euros. In Madise's opinion, the parish has no right to request this fee. She asked the parish to change the law, but the parish plans to do so only in 2026.
Madise has also addressed Tallinn. In her opinion, Tallinn's law is also in several places against the law. This law requires developers to pay money for the construction of public things.
