The Tallinn Circuit Court agreed with the Pärnu County Court that Kairi Kuusemaa is guilty of killing her child. The court upheld the county court's decision to sentence Kuusemaa to three years and nine months in prison.
The Pärnu County Court made the decision on February 20th. Following this, both Kuusemaa's defense and the prosecution filed appeals. The defense contested the county court's conclusions regarding the pregnancy and childbirth. The prosecution wanted Kuusemaa to be found guilty of desecrating a corpse as well.
The Circuit Court found that Kuusemaa knew about her pregnancy at least since December 21, 2023. The childbirth was not unexpected for her. The court found that Kuusemaa cut the baby's umbilical cord, but she did not kill the child because of it. The child died because Kuusemaa suffocated him.
The court also found that Kuusemaa cannot be accused of desecrating a corpse. The evidence showed that she may have buried the child in haste. The court acquitted Kuusemaa of the charge of desecrating a corpse.
The court decision is not yet final. In February, the Pärnu County Court found Kuusemaa guilty and sentenced her to three years and nine months in prison. The sentence began on March 9th of last year.
