The PPA revoked Isa Khalilov's residence permit. Khalilov is a Russian citizen who caused a severe car accident in 2020. However, he cannot be deported from Estonia because he is under court-ordered probation.
Khalilov was released from prison early. The court decided that he must be under probation until June 2030. He has a two-year behavioral control. This means he must regularly meet with a probation officer. He also has a monitoring device.
Probation cannot be changed. Only the court can decide whether to terminate it earlier. If the probation ends, Khalilov can be deported.
The prosecution said that probation is difficult for Khalilov. He was unable to pass the B2-level Estonian language exam in prison. He also finds it hard to find work. The Ministry of Justice said that probation is problematic if a person does not have a residence permit.
The probation officer must ask the court how to proceed. The court decides whether probation can end earlier. If the court decides so, Khalilov can be deported.
Khalilov has 24 months of behavioral control. If he behaves well, the probation officer can propose to the court to shorten the punishment. If the court agrees, Khalilov can be deported earlier.
The Ministry of Justice said that it may be necessary to change the laws. This would help to resolve such cases better. In Estonia, there has already been a case where a person was deported and probation was terminated.
